Please read this entire Acknowledgment and Assumption of Risks and Release and Indemnity Agreement (hereafter 'Document') carefully before signing. All participants must sign this Document. For participants under 18 years of age, parent or guardians must also sign.

 In consideration of being allowed to participate in any way in the program at Mountain Life Summer Camp, LLC (hereafter referred to from time to time as Releasees) its related events and activities, I (participant, and Parent/s of a minor participant) acknowledge, appreciate, and agree as follows: The risk of injury from activities involved in this program, including but not limited to horseback riding, vaulting, archery, hiking, among others, is significant, including the potential for serious injury, maiming, permanent paralysis, and death.   Additionally, recognition of the potential for pandemic illness is acknowledged. While particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury or death remains; and

 1. I, knowingly and freely assume all such risk, both known and unknown, even if arising from the negligence of the releasees, their employees or agents, or others, and assume full responsibility for the risks associated with my participation; and

 2. I, willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest Jameson Ranch Camp employee immediately; and

 3. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, do hereby release, and agree to defend, indemnify and hold Mountain Life Summer Camp, its counselors, officials, agents, employees, and owners, with respect to any and all claims, awards, fines, judgments, damages, losses and expenses of every nature arising out of or connected with any injury, disability, death, or loss or damage to person or property, whether arising from the negligence of the releasees or otherwise, to the fullest extent permitted by law (including without limitation costs, attorney fees, expert witness fees, and other expenses of litigation). This Release and Indemnity Agreement includes any losses caused or alleged to be caused, in whole or in part, by the negligence (but not the gross negligence or willful, wanton or criminal misconduct) of Jameson Ranch Camp, and includes claim/s for personal injury or wrongful death including claim/s related to emergency or medical response, assessment or treatment, property damage, products liability, breach of contract.

 4. It is agreed that any dispute or cause of action arising between the parties, whether out of this agreement or otherwise, can only be brought in the Blaine County Court located in Idaho, United States and shall be construed in accordance with the laws of Idaho.

 5. I agree that any dispute concerning, relating, arising out of or referring to the subject matter of this contract shall be resolved exclusively by binding arbitration in Blaine County, Idaho, according to the then existing commercial rules of the American Arbitration Association and the substantive laws of that state. Any dispute submitted to arbitration under this clause must be heard by the arbitrator(s) in its entirety within one year of submission, who must render his/her decision within thirty days of the close of the evidence.

 6. The arbitrator and not any federal, state or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or violable.

 This is to certify that I, as a parent/guardian with legal responsibility for this participant, do consent and agree to all of the terms of the Acknowledgment and Assumption of Risks and Release and Indemnity Agreement stated above, and further agree to my participant’s release as provided above of all the releasees, and, for myself, my heirs, assigns, and next of kin. I hereby release and agree to defend, indemnify and hold harmless the releasees from any and all liabilities incident to my minor child's involvement or participation in these programs, to the fullest extent permitted by law, and as expressed above.
